TERMS AND CONDITIONS

BOOKERS PROGRAM

Effective 1^st September 2023

01 ELIGIBILITY

1. The booker must be 18 years and above;
2. The booker must be a resident of Malawi;
3. There is no registration fee for bookers;
4. The booker must be registered online with Sunbird and Sunbird has the right to register or not register an applicant;

02 REDEMPTION BOOKING PROCESS

A booker shall make booking through Central Reservations.

03 BENEFITS AND OTHER TERMS

1. Points will be awarded upon settlement of invoices for cash payments
2. The calculation of points is provided in ANNEX 1;
3. Bookers are allowed to book a maximum of two room nights per stay in resorts and three in city hotels;
4. The Vincent’s Platinum and Vincent’s restaurants are not part of the redemption platform;
5. Membership which has been inactive for two continuous years will be scrapped off the system and benefits forfeited;
6. Members are allowed to redeem four meal vouchers per day;
7. Member benefits are neither transferable nor exchangeable for cash;
8. Members are supposed to present printed voucher and acceptable ID (such as National ID, Passport and Driving License) upon accessing services;
9. Vouchers shall not be used during Black-out dates. The following shall be blackout dates Easter and Christmas / New Year, high peak seasons and any other periods designated by Sunbird;
10. Vouchers will be valid for three months from the date of issue;
11. Usage of the voucher shall be preceded by a prior booking;
12. Vouchers will be valid for dates and rewards stated i.e. a voucher for a meal cannot be used for accommodation;
13. Points earned whilst in the employment of one particular company are transferrable when one changes jobs as long as the member continues to book;
14. The Programme Administrators’ decision is final;
15. Accommodation and meal vouchers will be valid for specified room or restaurant categories, unless otherwise endorsed by the Programme Administrator.

04 AMENDMENT

Sunbird reserves the right to amend these terms and conditions from time to time, provided that the members are given a one month’s notice.

05 LIMITATION OF LIABILITY:

In no event shall the owners, operators, franchisors or licensors of any hotel that may accept the benefits of membership herein, or any of their affiliated or subsidiary companies, or their directors, agents, managers, or employees, or the proprietor or the marketing agent of the Membership Program (hereinafter collectively “Protected Parties”) be liable for any indirect, special or consequential damages; and without limiting the generality thereof, including any loss, cost or damage to, or suffered by, the Member or others, arising from defects, negligence, delays, failure of performance or non- performance, including all claims, demands, obligations, liabilities, indebtedness, breaches of contract, breaches of duty or of any relationship, liability for acts, omissions, misfeasance, damages of every type, nature or kind suffered by Members or others, resulting from the action, or inaction of the hotel or its agents or employees in connection with the Benefits provided to Member herein. In the event of a breach of any the provisions hereof by any Protected Party, the extent of any liability of any such Protected Party shall be limited to the amounts paid by Member as a subscription for membership in the marketing program.

06 ERRORS AND RETROACTIVE CLAIMS:

All claims regarding the credit of free nights, redemption of vouchers, or use of other benefits of the Program, must be presented to the coordinator accompanied with the invoice of the stay or any another document supporting the claim;

07 PRIVACY OF DATA AND APPLICABLE LAW:

These terms and conditions are governed in accordance with the laws of Malawi and in the event of a dispute parties shall endeavor to settle the same amicably before resorting to the Courts.
